Del Antropoceno al Ecoceno: propuestas jurídicas de la transición ecosocial para el cuidado de la vida

En estos tiempos en que experimentamos, en primera persona, los límites de nuestra existencia, el COVID-19 ha demostrado ser otra de las múltiples consecuencias de la huella humana en el ecosistema Tierra. La destrucción de los hábitats, la extinción de la biodiversidad, la emergencia climática… han generado una situación de enfermedad global, que sitúa al sistema Tierra a los límites de su capacidad y en la que los seres humanos no somos para nada ajenos a las consecuencias de esta patología. El propósito de este artículo es reflexionar sobre la necesidad de promover una transición ecosocial hacia una nueva ecocivilización, en la que el paradigma jurídico asentado en la era del Antropoceno debe transitar necesariamente hacia el sistema vida, hacia el «Ecoceno», una nueva era en la que la vida es el centro y que se articula a través de un ordenamiento jurídico guiado por el bienestar y cuidado de todos los seres vivos. La conjunción de todos los elementos ecojurídicos resulta en el llamado «derecho de la Tierra», cuyo centro principal es el reconocimiento de la plurisubjetividad y la atribución de derechos a todos los seres vivientes del ecosistema Tierra.
