Systematization and summarized presentation of the doctrine established by the Superior Court of Justice of Aragon (TSJA) from 2010 when the Law on Equality in Family Relations in the event of parental separation came into force until the beginning of 2019, on the general provisions of this Law (purposes, rights and principles), the parenting plan and the first and main measure of application in default of the agreement of parenting plan: the guard and custody of children; in particular: shared custody, visitation schedule with the non-custodial parent in individual custody, the preferential right of shared custody, concurrent evidence, the factors to be considered in motivating the decision on the type of custody, the modification of custody or visitation schedule, the nature and function of the right of appeal to the TSJA in these matters.
