El interés que el derecho de consumo ha despertado en una sociedad cada vez más consciente de su posición determinante en el proceso consumista, ha dado lugar a un rápido y extenso desarrollo normativo que aspira no sólo a regular una materia determinada sino también a darle sentido fundamentalmente protector de derechos básicos. Los riesgos del desarrollo, o simplemente, los daños que puede sufrir cualquier consumidor, por un defecto del producto que presuntamente no es capaz de detectar la ciencia, y con los que la norma no es del todo beligerante, aparecen como un punto negro en ese régimen jurídico establecido, no solamente a nivel interno, sino el marco funcional, de la Unión Europea
