La convivencia de empresas de diversa nacionalidad en el mercado internacional revela a diario la importancia de la normativa laboral como factor determinante de la competitividad empresarial. En el marco flexibilizador de la reforma del mercado de trabajo, el articulo 41 del Estatuto de los Trabajadores se ha visto acompañado de un interesante cambio de perspectiva, toda vez que, en su aplicación, ha pasado de ser un "instrumento reaccional" a ser un "instrumento preventivo", válido para permitir la normal adaptación de las relaciones de trabajo a las transformaciones del mercado y de la demanda.
