• Los riesgos que implica la práctica del montañismo en la época invernal no son bien conocidos por la sociedad en general. Las avalanchas que cada año atrapan a montañeros y esquiadores son en la mayoría de las ocasiones desencadenadas por las propias víctimas. En este trabajo se ofrece una perspectiva jurídica del fenómeno del alud de nieve, apoyándose en el derecho comparado y analizando las
diferentes situaciones que comúnmente se pueden presentar; abordándose cómo se ha dilucidado la posible responsabilidad en cada caso y presentando unas líneas maestras de jurisprudencia. Palabras clave: Alud, esquí, nieve, responsabilidad, seguridad.
• The general public is not really aware of the risks involved in going mountaineering during the winter. The avalanches that trap mountaineers and skiers every year are mostly triggered by the victims themselves. This study looks at the phenomenon of the avalanche from a legal perspective, based on comparative law and analyses the various situations that can often arise, explaining how potential liability is resolved in each case, and presenting some broad guidelines provided by case law.
