Responsabilidad civil en los deportes de río

• El presente artículo pretende mostrar la realidad de la determinación de la responsabilidad en la jurisprudencia española sobre accidentes producidos durante la práctica deportiva en el medio natural, concretamente en los ríos. La creciente práctica de los denominados “deportes de riesgo” ha provocado que aumente el número de accidentes y, en consecuencia, las denuncias en relación a la responsabilidad civil al respecto. El artículo se divide en dos partes principales: 1) una aproximación teórica a los conceptos clave en la relación de la responsabilidad civil y el deporte en la naturaleza; y 2) un análisis de jurisprudencia real derivada de accidentes producidos durante la práctica deportiva en ríos.
• This article aims to show the reality of determining liability in Spanish case law in accidents caused by practising sport in the wild, particularly in a river environment. The growing popularity of socalled “extreme sports” has led to a greater number of accidents occurring and hence also in the number of claims involving civil liability in this respect. The article is divided into two main parts: 1) a theoretical approach to the key concepts regarding civil liability and sport in the wild; and 2) an analysis of actual jurisprudence deriving from accidents in river sports.
